These Terms form an agreement between you and Upsurge Labs LLP when you access jawd.in, use a JAWD account, or place an order through the Shopify checkout reached from our site.
Agreement to these terms
By using the site or ordering a product, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the site or place an order.
“JAWD”, “we”, “us”, and “our” mean Upsurge Labs LLP. “You” means the person using the site or buying or using a product. Mandatory rights available to you under applicable consumer law are not excluded or limited by these Terms.
Eligibility
You must be legally capable of entering into a binding contract to purchase from JAWD. If you are under 18, a parent or lawful guardian must place the order, accept these Terms, decide whether the product is appropriate, and supervise use.
You must provide complete and accurate checkout information and use only a payment method you are authorized to use. Products are currently offered for delivery only to supported addresses in India.
Product safety
JAWD is a fitness accessory. It is not a medical device, diagnostic tool, treatment, or substitute for professional dental or medical care.
Read and follow all instructions included with the product. Start with the lightest appropriate resistance, use a slow and controlled motion, do not exceed the recommended use, and inspect the product before each session. Do not bite, chew, or use the product in a way that conflicts with its instructions.
Stop immediately if you feel pain, clicking, locking, unusual fatigue, tooth sensitivity, numbness, dizziness, or other discomfort. Do not use JAWD if you have an active jaw, dental, facial, or temporomandibular-joint concern, recent oral or facial surgery, loose dental work, or another condition that could make use unsafe unless a qualified dentist or healthcare professional has first advised you that it is appropriate.
Keep the product away from young children and pets. Do not share an oral-use product with another person. Clean and dry it as directed. Replace it if it is torn, deformed, cracked, degraded, contaminated, or otherwise damaged.
Product information
We try to present product descriptions, images, resistance levels, price, availability, and other information accurately. Screen colours, handmade or manufacturing tolerances, packaging, and minor details may vary. Resistance labels describe the product variant; they are not a clinical measurement of your jaw strength or a promise of a particular result.
Products are subject to availability. We may correct an obvious error or update product information before accepting an order. If a material correction affects an accepted order, we will contact you and offer the options required by applicable law.
Orders & acceptance
The JAWD site lets you select products and sends your chosen items to a Shopify-hosted checkout. Adding an item to the cart does not reserve stock. Your order is an offer to buy. An automated acknowledgment or payment authorization does not by itself require us to accept an order.
An order is accepted when Shopify confirms it for fulfilment or we otherwise communicate acceptance. We may refuse or cancel an order before fulfilment for a genuine reason, including unavailability, an obvious price or description error, suspected fraud or misuse, a payment problem, an unsupported delivery location, or a legal restriction. If payment has already been captured for a cancelled order, the refund will be initiated through the original Shopify-connected payment route.
Shopify is the authoritative record for your order, payment status, tax, inventory, fulfilment, cancellation, and refund. Keep your order confirmation for reference.
Price, tax & payment
Prices are shown in Indian rupees unless stated otherwise. The final amount, applicable tax, shipping charge or discount, and available payment methods are displayed at Shopify checkout before you confirm payment. Product prices are intended to be tax-inclusive where shown as such at checkout.
Payment is processed through Shopify and the payment provider offered there, including Razorpay where available. JAWD does not receive or store your full card, UPI, bank-account, wallet, or other payment credentials. A payment may be declined or delayed by Shopify, the payment provider, your bank, or another participant in the payment network.
Delivery
Current delivery coverage, price, and estimates are shown on the storefront or at checkout. Delivery dates are estimates unless we expressly agree otherwise. Delays may occur because of address issues, weather, carrier capacity, public events, remote locations, or other circumstances outside reasonable control.
You are responsible for providing a complete and deliverable address and a working contact number. Review the package promptly on delivery. If it appears damaged, tampered with, incomplete, or incorrect, preserve the packaging and contact jawd@upsurge.io with the order number and useful photographs.
Cancellations, returns & refunds
Contact jawd@upsurge.io as soon as possible if you need to cancel. We may be able to cancel before fulfilment begins, but cannot promise cancellation after an order enters packing or ships.
Because JAWD is intended for oral use, an opened, used, or hygiene seal-broken product is not eligible for a change-of-mind return. This hygiene rule does not remove any right you may have under applicable law for a product that is defective, damaged, unsafe, not as described, or incorrectly supplied.
Unopened and sealed products may be considered under the return policy presented at Shopify checkout or on your order page.
To report a damaged, defective, incomplete, or wrong item, email jawd@upsurge.io within 7 days of delivery with your order number and photographs. We arrange return pickup at our cost and send a replacement, or a full refund if the replacement is out of stock. There is no restocking fee. Do not send a product back until we provide return instructions. This reporting window does not limit your rights under applicable consumer law.
Approved refunds are initiated through Shopify to the original payment route unless applicable law requires another method. The time for the amount to appear can depend on the payment provider and your bank. We will provide status information reasonably available to us.
JAWD accounts
A JAWD account uses your verified email address and a one-time code; no password is stored. You are responsible for controlling access to that email account and for not sharing a one-time code. Tell us promptly if you suspect unauthorized access.
Order history is matched to the verified checkout email. Do not attempt to access another person’s orders. We may revoke a session or limit account access to protect you, other customers, or the service, investigate misuse, comply with law, or maintain the system.
Acceptable use
You must not:
- use the site unlawfully, fraudulently, or to infringe another person’s rights;
- interfere with the site, bypass a security or access control, test for vulnerabilities without written permission, or send malicious code;
- scrape, copy, or use automated tools against the site in a way that burdens the service or violates law;
- impersonate another person, use false checkout details, abuse promotions, or attempt unauthorized account or order access; or
- resell a product in a misleading, unsafe, tampered, or unlawful manner.
Ownership
The JAWD name, branding, site design, photographs, illustrations, product presentation, copy, software, and other site materials are owned by or licensed to Upsurge Labs LLP and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to use the site for personal, lawful shopping and account access. No other right is granted. You may not reproduce, publish, adapt, sell, license, or commercially exploit our materials without written permission, except where law permits.
Third-party services
The site connects to services operated by others, including Shopify checkout, payment providers such as Razorpay where offered, delivery providers, and tracking links. Their terms and privacy notices may apply to the part of the service they operate. We are not responsible for a third-party service outside our reasonable control, but this does not limit responsibility that applicable law places on us as the seller.
Service disclaimers
To the extent permitted by law, the site is provided on an “as available” basis. We do not promise uninterrupted access, that every error will be corrected immediately, or that every device or browser will display the site identically.
Individual experiences with resistance training vary. We do not guarantee cosmetic, strength, wellness, dental, medical, or other results. Product reviews or user statements, if shown, describe individual experiences and are not professional advice or guaranteed outcomes.
Nothing in these Terms excludes an express product promise we make to you or a warranty or consumer protection that cannot legally be excluded.
Responsibility & liability
You are responsible for following product instructions, warnings, hygiene guidance, and professional advice applicable to you. You are also responsible for losses caused by your unlawful misuse of the site, unauthorized access attempts, false information, or infringement of another person’s rights.
To the extent permitted by law, neither party is liable to the other for an indirect or consequential loss that was not reasonably foreseeable when the contract was formed. Any limitation in these Terms applies only to the extent the law allows and does not limit liability for fraud, wilful misconduct, death or personal injury caused by negligence where it cannot be limited, or a mandatory consumer remedy.
Law & disputes
These Terms are governed by the laws of India. Before starting formal proceedings, please contact jawd@upsurge.io so we can try to resolve the issue directly. If it cannot be resolved, a dispute may be brought before the court, consumer commission, or other forum that has jurisdiction under applicable law.
Nothing here prevents you from using a grievance or consumer-redress mechanism available under applicable law.
Changes, severability & contact
We may update these Terms to reflect changes in the service, products, providers, or law. The effective date at the top identifies the current version. The Terms in effect when an order is placed generally govern that order unless law requires otherwise.
If a provision is found unenforceable, it will be limited or removed only to the extent necessary, and the rest will continue to apply. A delay in enforcing a provision is not a waiver. We may transfer these Terms as part of a genuine business reorganisation or sale; you may not transfer your rights or obligations without our written consent.
